Terms of Service

Welcome to TeachKit AI ("TeachKit," "we," "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, AI tools, templates, and marketplace (the "Platform"). By creating an account or using the Platform, you agree to these Terms.

1. Eligibility & educator-only accounts

The Platform is intended for educators and other adults aged 18+. It is not directed to children. You may not create an account on behalf of a child, and students are never account holders. See our Privacy Policy for children's-privacy details.

2. Your account

You are responsible for safeguarding your credentials and for all activity under your account. Provide accurate information and keep it current.

3. AI-generated content

The Platform produces AI-assisted materials. Output may contain errors or omissions and is provided as a starting point only. You, the educator, are the professional decision-maker and are responsible for reviewing, verifying, and adapting all content (including standards alignment and age-appropriateness) before any classroom or other use. 4. No student data

You agree not to enter student names, identifiers, or any personally identifiable information ("PII") into prompts or stored content. You are responsible for compliance with FERPA and applicable privacy laws in your use of the Platform.

5. Plans, credits & billing

Paid plans and AI credits are described on our Pricing page. Subscriptions renew automatically until canceled. Credits reset each billing cycle and do not roll over unless stated. Prices may change with notice.

6. Intellectual property & license to you

Subject to your plan and these Terms, you receive a license to use the resources you generate for your own teaching. The Platform, its software, and its prompt systems remain our property. Marketplace products are licensed under the terms set on each listing (Personal, Classroom, or Commercial).

7. Marketplace & sellers

Sellers are bound by the Marketplace Seller Agreement, warrant that they own or have rights to everything they upload, and indemnify us against IP claims. We may review, reject, or remove listings. Commission and payout terms are disclosed at sale.

8. Acceptable use

Do not use the Platform to create or distribute unlawful, infringing, hateful, explicit, deceptive, or harmful content; to submit PII; to resell others' intellectual property; or to abuse, reverse-engineer, or overload the service.

9. Refunds

Digital goods and AI credits are generally non-refundable once delivered or consumed, except where required by law or for technical defects/material misrepresentation. Subscription refunds follow our posted refund policy.

10. Disclaimers & limitation of liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TeachKit is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid in the 12 months preceding the claim.

11. Copyright / DMCA

We respond to valid DMCA notices and maintain a repeat-infringer policy. Send notices to our designated agent at Support@teachkitai.com.

12. Changes & termination

We may update these Terms and may suspend or terminate accounts that violate them. Continued use after changes constitutes acceptance.
